These Terms of Service (“Terms”) govern your use of Curbswap’s website, mobile app, and services. By creating an account, joining the waitlist, pre-ordering, or using Curbswap, you agree to be bound by these Terms. If you do not agree, do not use Curbswap.
1. Acceptance of Terms
By accessing or using the Curbswap website or application (together, the “Service”), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Description of Service
Curbswap provides a subscription-based vehicle moving and parking service in the Los Angeles area. Our platform connects customers with vetted drivers who relocate vehicles to avoid street sweeping citations and parking violations.
3. Eligibility
You must be at least 18 years old and a legal resident of the United States to use Curbswap. By using the Service you represent and warrant that you meet these requirements.
4. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@curbswap.co if you suspect unauthorized use.
5. Vehicle Authorization
By adding a vehicle to Curbswap, you represent that you are the registered owner or have explicit authorization from the owner to allow Curbswap drivers to operate the vehicle. You assume full responsibility for ensuring this authorization is valid.
6. Subscription, Pre-orders & Billing
Curbswap offers subscription plans billed monthly. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. The Curbswap SwapBox™ is a one-time device charge; pre-order payments reserve a device that ships when we open your neighborhood. Refunds are issued at our sole discretion in accordance with our Refund Policy.
7. Driver Conduct
All Curbswap drivers are vetted, background-checked, and insured. However, Curbswap is not liable for incidental damage, loss of personal property left in vehicles, or citations issued due to inaccurate parking information provided by the customer.
8. Prohibited Uses
You may not use Curbswap for any unlawful purpose, to violate any applicable laws or regulations, to transmit false or misleading information, or to interfere with the operation of the platform.
9. Limitation of Liability
To the maximum extent permitted by law, Curbswap and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes via the app, website, or email.
